Mpumalanga keeps roulette betting legal despite Gauteng’s Supreme Court ruling
The Supreme Court of Appeal (SCA) judgment regarding roulette betting in Gauteng has sparked clarity from the Mpumalanga Economic Regulator (MER). The ruling, specific to Gauteng, does not impact Mpumalanga's betting landscape, where roulette bets remain legal for licensed providers like Betmgm and Bet365.
The SCA judgment, in the case of Portapa (Pty) Ltd t/a Supabets and Others v Casino Association of South Africa and Another (182/2024; 215/2024) [2025] ZASCA 158, upholds the High Court's decision that roulette is not a sporting activity. This makes fixed-odds bets on roulette unlawful in Gauteng.
However, the MER has clarified that this ruling does not affect Mpumalanga's legal framework for betting specialties. Under the Mpumalanga Gambling Act, licensed bookmakers can continue to offer bets on roulette and other casino games. The MER ensures that betting offerings in Mpumalanga align with the province's regulations, not affected by the Gauteng-specific SCA judgment.
In light of the SCA judgment, the MER has confirmed that Mpumalanga's betting scene remains unchanged. Roulette bets, along with other casino games, continue to be lawful for licensed providers like Betmgm and Bet365 in the province, adhering to the Mpumalanga Gambling Act.
