Mount Airy Casino settles $2.3M lawsuit over wage and tip violations
Mount Airy Casino Resort has agreed to a $2.3 million settlement in a class-action lawsuit brought by nearly 700 current and former employees. The case, filed in 2022, accused the casino of violating federal wage laws by mishandling tips and failing to inform staff about tip credits.
The lawsuit began when two employees, John and Jane, filed claims in the Middle District of Pennsylvania. They alleged that Mount Airy Casino Resort breached the federal Fair Labor Standards Act (FLSA) by not properly informing workers about tip credits and by improperly pooling tips.
Under the settlement, around $1.47 million will be distributed to the affected employees. Each eligible class member will receive at least $100, with an average payout of about $2,000. The remaining funds will cover legal fees and administrative costs. A final approval hearing for the agreement is scheduled for February 19 in Wilkes-Barre. If approved, the settlement will resolve all claims related to the casino’s tip practices.
The settlement brings an end to a two-year legal dispute over wage violations at Mount Airy Casino Resort. Once finalised, the $1.47 million payout will be shared among nearly 700 employees, with distributions expected to begin shortly after court approval.
